My legal troubles with Roca Labs

Hi everyone!

I wanted to let you all know that I may be sued for $300,000.  It has to do with “the constitutional protection of free speech” and how it is not unlimited.  “Negative postings by those who falsely represent that they possess nutritional or medical expertise” is something they have written to me.  I am NOT an expert on weight loss.  I have NO expertise about weight loss, except the training I received as a cashier at weight watchers once I hit goal weight back in 1997.   The letter states that I “carelessly expose other customers to liability by soliciting them to post disparaging comments on her blog site, thereby breaching their own non-disparagement agreements.”  I wanted this stated here so you all have the chance to remember what you signed…..

As explained, this is not a suit right now, it is a letter that they are gathering proof to measure the damages, and to send a demand letter.  Please read terms and conditions on the Roca Labs site, before you order the diet aid.

ps.  I will state once again that when I ordered the powder in April, 2011 there was absolutely NOTHING written about not writing on the internet anything negative.  They sent me what they thought were the terms and conditions at that time.  The terms I received were not accurate to the time I ordered the formula.

Like most of you, I have been battling weight issues since childhood. I am definitely a fan of WW and Jenny Craig. My thoughts as I begin this site is whether this "diet" by Roca Labs can help get over the speed bumps that sometimes feel more like those big square curbs or even several large boulders....

    Hi Kathy,

    I have always wondered why everyone seems to have an issue with the legal department. My blog has been up for months and I have expressed my opinion and I have received nothing. However, I do think that some of the postings on the blog can be biased and I can see how it affects business.

    I think you should give the formula another shot. I can work with you if you would like to. I have A LOT of tips and I could go on forever. :)

          I just wanted to let you guys know that I saerttd taking the Roca Labs formula on Sunday of this week and as of today have lost 7.6 pounds. I know this isn’t water weight either because in the last month I had already lost 20 pounds (counting the 2 pounds I lost when I had gotten on the scale Sunday morning.) I took the day off yesterday from taking it (as suggested to take one or two days off a week from using it) and I still ate very small portions and felt full. I have not been paid by Roca Labs or anything, I just am trying to get the information out there for those that want to try it so that they know it does in fact work if you use it properly. Dosing does take some trial and error, and it is extremely important to keep hydrated with water to keep the formula expanded in the stomach through out the day. But I would recommend this to anyone who really wants to lose weight.

      I took a full dose of the Roca Labs as instructed. An hour later I was able to eat a Culver’s triple cheese burger and fries with no problem at all. I know a few people who have had gastric bypass surgery, and there is no way they could eat even 1/4 of a Culver’s triple cheese burger . They couldn’t even eat a whole order of fries with out a burger. It’s a scam. It’s false advertising.

    I ordered their product over a year ago and I had a complaint about not losing as much weight as they told me too, they were very helpful addressing my concerns. I sent a video telling them about my experience and although the video was not praising the product, I got the promised 50% refund. I hope everything works out well for you.

  3. They are right as you are disturbing us to succeed with this Roca Labs formula. Your post here is some kind of personal revenge because you failed to succeed and you are telling everyone how not to succeed either because you probably have an eating disorder or other psychological issues (as we all fat people do but we, as oppose to you Kathy, want to succeed).

    You obsession with this great weight loss product is too much and maybe you drove them to sue you.

    I also bought this product and it is the best and the strongest weight loss I have ever tried. The problem is… my mind. I have to understand that I am not hungry. My friend from the Golf lost 42kg and this Roca Labs is given in the hospitals in Dubai where the rich people can efford. Did you know that?

      That is a great point, Mrs. Schwartz. I absolutely did not know that in Dubai there are hospitals that are giving this aid to patients. That is great news to know that a medical staff is using the powder. Is there a site you can recommend that speaks of their results?
      I am going to try the powder again in a few weeks when I am at my best to try to lose weight. I am sure most people read this site and know how badly I want to lose around 50 pounds. I know it is only my own fault that I was unsuccessful because I did not keep up with the instructions to exercise and eat better foods.
      Thank you so much for sharing your excellent results. There are a lot of us that want to have positive results and we need more ideas on how to get them….

    You are definitely right, Mrs. Schwartz. Everybody wants to succeed with this Rocalabs formula and I have lost weight already ( I just need to focus as I really love to eat ). I think it is more up to ourselves, they have given us a way to lose weight. We just need the will to do it. What’s great is that you can lose weight even if you do not have time to exercise because we all lead busy lives.

    Besides, it came from you that you are not an expert so you cannot give expert comments.

    Hi Kathy. I am looking into weight loss methods and products and came across your site. I find the posts somewhat confusing because it isn’t clear who did what, but obviously you have had some issues with Roca Labs.

    Then, in your last post you wrote, “In any event, I know it is only my own fault that I was unsuccessful because I did not keep up with the instructions to exercise and eat better foods.”

    Based on that comment, I’m assuming that the product isn’t the problem and I think I will try it. I look forward to hearing of your progress in your next attempt and I will be sure to share my results with you.

    Hi everyone, I have been using the product now Day 9 and I am down 6.2 lbs. I am glad someone started a forum and I think it is good for someone to express that the product is not working for them and can get help from the ones like me who are having great results. It is all about experimenting and not giving up. I think we just need a support team/forum to work out like you say some of mental issues when it comes to sticking to any weight loss method. I am taking a day off today of the product and I still feel full. I just ate a small breakfast and have the full feeling that I had when I was taking it. So let’s all try out Debron’s forum and work on this together.

    I find it fascinating that people have opinions about things they have yet to try. This is Kathy’s blog, right? This is the forum for her to speak, correct? I’m under the impression that the people who have commented the past few times are Roca Lab employees. That’s just my impression though…as they have theirs, and Kathy has hers.       If I can say one thing, I keep trying;)
      There is no way for me to tell if someone writes on my site from the company or not. I started this site knowing I wanted to bring to light BOTH sides. I will let each person reading this decide for themselves what may be written by someone from the company.

    I started using this product a few weeks ago and have not lost any weight, I’m beginning to feel quite discouraged. Is there something I’m doing wrong? Do you have any tips?

      Hi Rae,
      From what I hear from others who have been successful is that you have to find the right amount of the mixture that will help you. Maybe it means taking more, or using it at a different time. I am really not the one to ask, considering I have not had success now for three times trying in the past 10 months.

        If you want to loose 25-50 pnds, click here , etc. You except to rceieve a more specified version accostumed to your needs as you specified them on their forms.Basically, you are sent 3 spoons for you to decide how much you have to take. I said to myself, it cannot be a very effective or strong product when they let customers decide if they take 1 spoon or 3, which led me to assume that as far as a medical or expert advice I was on my own and I needed to try the formula until it fit my needs.This became a hassle since if I’d take the purple spoon, I’d have horrible crampings, bloating and almost lost myself in the intimacy of my bathroom. If I took the green spoon, I was as hungry as a lion in winter and disgusted by the taste and guy stuff I had to drink which did nothing to me.I still kept trying for another 2 weeks. I lost 0 pounds, sorry I lost 0 ounces after 3 1/2 weeks.I decided to give them a call, and they answered. I explained the concerns I had with the formula and was seeking advise as to how to return it, if not for the whole amount at least for a portion, the lady went cold on the phone and literally said Madam we do not handle refunds since this is a medical formula that cannot be returned after the seal is broken, please send us an email with your concern and the phone went cold.After that conversation I have emailed Roca Labs more than 5 times and have rceieved no answer at all. More than 5 weeks have passed and I am totally unhappy with the results, the way they handled my call and how unproffesional it looks to send a product without specifics instructions as to the portion or dosage to be taken but then considered a medical formula when it comes to the refund.What happened to your refund policy? Every company states them and have them implemeted and it reimburses the customers up to a certain point regardless of an open product, etc.As to me, the formula is sitting in my kitchen as to I don’t want to keep taking something that leaves me starving or cramping. I would love to know if anyone knows how I should handle this situation, and if anyone has resolved any refund situations with Roca Labs .Thank you.

    I agree with Angel. It sounds like you’ve been bullied into backing off expressing your opinions about your experiences with the product. I am interested as well in hearing the truth about boths sides (good, bad or indifferent). I don’t go to a blog to get expert opinions, I go to blogs and forums to hear real life experiences. Anyone who seeks medical advice from a blog is an idiot. If you’re already experiencing issues with staying on the weight loss path, don’t let anyone vicitimize you into being silent about your journey. Add a disclaimer to your blog, and keep sharing your experiences. There is no shame in saying that the product simply didn’t work for you (if it didn’t)…and allowing others to make their own decisions.

    A friend was considering starting Roca Labs Formula a few weeks ago. She found that the videos on YouTube were very helpful in making her decision. She has been losing weight since she decided to start the Roca Labs Formula.

    Before I ordered the product, I went through the Roca Labs website with a fine-toothed comb, and I mean I read EVERYTHING. It is clearly stated in the Terms & Conditions (that it seems few people bother to read for ANY product or service) that…

    Hello Kathy,

    Let me first tell you I am 31 at 360 pounds, I work 3 Jobs and have two little ones and a wife that works second shift. A couple days ago I went to the doc office to find out the weight is killing me. Ii have an enlarged Heart. By the time I get off of work the local babysitting is over and I am unable to work out. I am trying to find somthing that works. You said this is your fouth time trying this IS THIS TIME WORKING FOR YOU?

      I am so sorry to hear of your struggles. I am only around 60 pounds overweight, so I can only imagine the pain you are going through. I am sad to report that the fourth time did not work for me with Rocalabs. Maybe not having an exact menu to follow is the problem. Even if it does full up your stomach as advertised, you have to figure out what to eat to make sure you aren’t hurting your body with lack of nutrition or lack of energy with the space you have left. The cravings were too difficult, the taste was yucky, and I couldn’t stick to it more then a week or two. Right now I have found something that is low carbs and more protein. So far, so good…..
      I will keep everyone up to date.

      I have thought about Jenny Craig or Weight Watchers or even Nutrisystem but I ralely don’t know which one is best and I am ralely bad with decisions! My fiance keeps telling me that he loves my body he just wished I would love it as much as he does. But, I just cant.. I not only dislike it.. I HATE it and its ralely not fair to him. And all of this stress of trying to lose it before my wedding certainly isn’t helping. I know what you mean about that first 10 lbs I wish I hadn’t let it become such an obsession because it just made it feel hopeless and you’re right 10 turns to 20 and 30 and so on so quickly and now it REALLY IS a hopeless task . I never thought Id see 200 on the scale Especially not 240 I don’t know how I let this happen. I know hoping for a miracle pill isn’t realistic. But I have to do SOMETHING and FAST.

    I am now on my 2nd week of the product and I only lost 4 lbs. At first I was a bit frustrated because I am expecting more. But I was advised by their support staff that I am within the expected weight loss and a slow-pace of weight loss is ok, this can also help prevent loose skins in the future. I am still looking forward to getting may weight loss goal which is 40 lbs in 2-3 months.
